- Abstract
- 사무장병원은 국민의 건강을 위협하고 국민 전체의 재정부담을 악화시키고 있으며, 의료생태계를 교란시킨다. 실질적 규제를 위한 법적 보완이 조속히 이루어져야 할 필요가 있다. 본 연구에서는 국민의 건강에 위협을 가하는 사무장병원의 의의와 유형, 그리고 불법적 특징을 고찰하였다. 불법개설기관에 대한 해외입법사례를 비교 및 검토하였다. 또한 사무장병원을 규제할 수 있는 의료법과 건강보험법을 검토하고 규제의 한계를 보완할 수 있는 쟁점과 개정안을 검토하였다. 국민건강보험공단의 특별사법경찰권 일부개정법률안의 필요성을 고찰하였다. 또한 건강보험법 57조 제2항 제3호에 의료법 제33조 제8항 외에 제10항을 추가하는 개정안을 정리하였고, 추가로 건강보험법 47조의2에 제1항, 제3항에 ‘의료법 제33조 제2항’에 관한 부분은 헌법에 합치되지 아니하므로 보완할 것을 제안하였다.
