스토킹처벌법 실효성에 대한 일반인의 인식: 스토킹 통념과 법의식의 영향

| dc.description.abstract | 스토킹 가해자 처벌 및 피해자 보호를 위해 마련된 스토킹처벌법이 2021년 10월 21일 본격 시행 되었으나 법 시행 이후에도 스토킹 범죄는 끊임없이 이어져오고 있다. 스토킹에 대한 두려움이 커지고 가해자를 향한 강력한 처벌을 요구하는 여론이 들끓고 있지만 스토킹처벌법 시행여부는 인지조차 제대로 되고 있지 않은 실정이다. 스토킹처벌법과 관련한 연구에는 범죄의 구성요건이나 피해자 보호제도에 관한 문헌연구가 대다수를 이루고, 스토킹처벌법의 인식에 관한 연구는 매우 미흡한 상황이다. 따라서 단순히 법의 제정에만 그치는 것이 아닌 법을 다양한 측면에서 바라보고 법의 실효성을 높일 수 있는 지속적인 연구가 필요한 시점이다. 이 연구는 스토킹 범죄 처벌을 위해 마련된법 제정의 억제 효과성을 알아보고, 스토킹 통념 및 법의식 수준이 법 실효성 인식에 미치는 영향력을 확인하고자 하였다. 연구 결과, 스토킹 통념과 법의식 수준에 따라 스토킹처벌법의 실효성 인식이 달라진다는 사실을 발견하였고, 결론의 일반화를 위해 다양한 후속 연구결과들이 축적되어야 하는 점은 한계로 지적되었다. 향후 스토킹처벌법을 개정·교육함에 있어 스토킹 통념과 법의식을 고려 하여 법의 실효성을 높이는 방안을 강구해 나갈 것을 제언하였다. | - |
