- Abstract
- Fire-fighters are responsible for protecting the lives and properties of the people from fires and disasters as a guardian who protects them. Legal protection should be provided in that fire-fighters perform their tasks. However, in spite of the 30 times of Amendment of the 「Framework Act on Fire-fighting Services」 since it was enacted in 2003, the severity of the interference behaviors to fire-fighters has not been reflected in the revised laws. Recently, there are many cases of assaulting 119 paramedics and social interest has been amplified accordingly. As a result, each level of society requires fire-fighting activities interference behaviors to be prevented and the punishment to be strengthened.
This article thus tried to review the efficiency in punishment of the offenders according to the type of interference by analyzing and reviewing the legal system on criminal punishments for fire-fighting activities intereference behaviors, based on the current 「Framework Act on Fire-fighting Services」 and the 「Act on 119 Rescue and Emergency Medical Services」 Especially, this article attempted to judge that the infringement caused by fire-fighting interference in that fire-fighters perform fire-fighting activities tasks is a violation of national legal interests. Therefore, in this article, the strengthening of penal legislation was emphasized, based on the type, form, and punishment status of fire-fighting activities task interferers, to strengthen the vocational consciousness of fire-fighters and to ensure efficient fire fighting activities. In addition, this article intended to provide a policy-related and legislative improvement plan as a direction of safety and welfare promotion for fire-fighting activities in terms of fire-fighting officers tasks.
