입법평가의 필요성에 관한 연구

초록

Purpose This study aims to review the concept and importance of legislative evaluation, emphasize the necessity of introducing legislative evaluation in the criminal justice system, and propose a plan for introducing the legislative evaluation system in Korea by comparing and analyzing the legislative evaluation systems of various countries and the impact assessment system of Korea. Methods We analyzed previous studies on legislative evaluation conducted in Korea since the late 2000s and cases of countries implementing legislative evaluation. Based on this analysis, we systematically organized the concept, necessity, and introduction plan of legislative evaluation, and derived specific directions for improvement by comparing it with the current evaluation system in Korea. Results As a result of the study, we confirmed that the scope of the impact assessment system in Korea is limited compared to countries such as the United States and the United Kingdom that evaluate overall regulations or Germany and France that comprehensively evaluate legislative proposals. In addition, while foreign cases have established systematic standards and methods over a long period of time, Korea has the problem of applying different standards and methods for each impact assessment. Conclusion Based on the results of the study, we evaluated the current impact assessment system and suggested that it is necessary to first introduce a comprehensive and systematic legislative evaluation system. Furthermore, after the legislative evaluation system has been stably established, we have reached the conclusion that the current impact assessment system should be integrated into the legislative evaluation system.
