지방자치단체 출자․출연기관 관련 법제의 현황과 과제

초록

Local governments establish and manage invested and funded institutions to enhance residents' welfare and promote regional economic development. These institutions are regulated under the Act on the Operation of Local Government-Invested or Funded Institutions. However, the enactment of the Act in 2014 has been criticized for procedural deficiencies, particularly the failure of the Ministry of the Interior and Safety and the National Assembly to conduct public hearings, thereby breaching the principle of due process. As a result, the inability to adequately reflect the views of relevant stakeholders and institutions has led to significant operational challenges for these local government-funded and performing organizations. To ensure that local government-funded and performing organizations faithfully fulfill their public functions by providing essential goods and services necessary for residents' welfare from a survival-oriented perspective, institutional measures must be implemented to overcome restrictions on their managerial autonomy.
