공공체육시설 사용 및 수익 허가 등에 관한 법적 문제 및 개선방안 연구 -제주특별자치도 자치법규를 중심으로-

초록

This study aims to enhance the realization of the right to sports and the expansion of grassroots sports by promoting the active use of public sports facilities. Despite the growing demand for such facilities, current legislation fails to provide clear legal standards or procedures for granting usage and profit permissions. Focusing on the local ordinances of Jeju Special Self-Governing Province, this paper identifies key limitations such as vague legal provisions, ambiguous legal liability of entrusted managers, and the conflict between public interest and profitability. In response, this study proposes legal and institutional reforms, including amendments to local ordinances, clarification of liability in case of accidents, and prioritization of vulnerable groups in profit-related decisions. Comparative legal analysis, particularly of Japan’s designated manager system, offers further implications for Korea. This research contributes to strengthening the legal foundation for the efficient and equitable use of public sports facilities.
