소년범 선도조건부 기소유예 제도의 지역별 운영 현황과 제도 개선방안

초록

This study empirically analyzes regional disparities in the operation of the Guidance-Conditional Non-Prosecution System for Juvenile Offenders using statistical data from the National Federation of the Ministry of Justice’s Youth Crime Prevention Committees. The findings indicate significant variations among prosecutors’ offices, largely due to differences in the organizational capacity of local Crime Prevention Committees and the strength of community cooperation networks. Regions with professionalized committees and multi-agency collaboration demonstrated higher effectiveness, while others showed limited outcomes owing to personnel shortages, aging membership, and administrative inconsistency. To address these issues, this study proposes key policy measures such as clarifying legal standards, enhancing program consistency and professionalism, institutionalizing regular committee appointments, and establishing interagency cooperation systems. These improvements are expected to reduce regional disparities and reinforce the rehabilitative and reintegrative goals of the juvenile justice system.
