북한 학계의 국제사법 연구 - 저촉원칙에 관한 기본이론을 중심으로

This study aims to trace the trajectory of private international law (hereafter PIL) scholarship in North Korea and to identify how North Korean researchers interpret the Law on External Civil Relations (Taeoe minsa kwan'gye pŏp), by reviewing and analyzing PIL-related materials published within the country. The materials examined comprise North Korean legal dictionaries and encyclopedias, the PIL textbook used at Kim Il Sung University, and PIL-related articles in North Korean academic journals, all obtained by the authors. The scope of review is confined to the basic theory of conflict-of-laws principles PIL in its narrow sense and to the general provisions in Chapter 1 of the Law on External Civil Relations that correspond to this theoretical framework. The review finds that, although North Korean PIL literature contains ideological narratives attributable to the country's political and social conditions, in substance it exhibits a tendency to examine and incorporate scholarly discussions outside North Korea. North Korean PIL researchers thus appear to have developed interpretations and analyses that, to a certain degree, align with international trends, under the policy imperative of promoting foreign economic relations.
