초록

This study aims to identify the significant penal implications of Spain in terms of improving limitations of the Korean correctional system, in which gradual reintegration has not been sufficiently realized. Due to its predominantly closed institutions, it is necessary to explore new ways to revitalize a Korean model of current open correctional facilities by applying the policy of the Catalan model, where open prisons are operated on the basis of a progressive treatment system. Institutions such as Cheonan Open Prison, Somang House, and Hope Center are formally classified as open facilities; however, their number remains limited, inmate autonomy and outside activities remain low, and a clear hierarchy and functional differentiation among facilities have yet to be established. By contrast, Catalonia operates open prisons as a core stage of sentence execution and substantively supports inmates’ reintegration by institutionally guaranteeing outside work, social participation, and victim compensation. This study analyzes the Catalan model, draws policy implications for the Korean correctional system, and proposes measures for revitalizing Korean-style open facilities, including the establishment of a stepwise hierarchy among facilities, the expansion of community contact and autonomy, the linkage of victim compensation with economic activity, and the development of eligibility criteria consistent with the purpose of open treatment. Furthermore, the revitalization of such open facilities must proceed alongside efforts to overcome Korea’s practical constraints, including securing community acceptance, easing punitive public sentiment, and establishing legal and institutional foundations for public-private cooperation, ultimately contributing to a correctional system oriented toward reentry.
