A Study on the Perception and Legal Validity of the Right to block News Articles

초록

This study examines the perceptions of stakeholders regarding the right to block online news articles and evaluates the legal validity of such a right. To explore perceptions of this practice, this study conducted in-depth interviews. In addition, the study examines the legal validity of the proposed right to block article access included in the 2026 amendment bill to the Press Arbitration Act. The findings show that opinions regarding whether article access blocking infringes upon freedom of the press are divided. In contrast, a clear majority of respondents agreed that article access blocking can play a meaningful role in protecting personal rights. The legal analysis suggests that the introduction of a right to block article access has a legitimate objective in protecting individual reputation and privacy. However, because such a measure may restrict freedom of expression and the public’s right to know, its application must be carefully limited and supported by clear criteria and procedures.
