| dc.description.abstract | 본 논문에서는 온라인디지털콘텐츠 제작자 보호와 관련한 주요 쟁점들을 살펴보았다. 구체적으로 디지털콘텐츠 부정이용의 방지와 기술적 보호조치, 제작자 및 공급자 식별표시제도의 불명확성 문제, 거래인증 및 품질인증의 문제, 온라인서비스제공자의 책임제한, 손해배상청구권과 과실책임주의 등을 다루었으며 최종적으로 온라인디지털콘텐츠 제작자 보호를 위한 법의 제정을 위한 기본적인 방향과 내용에 대하여도 살펴보고자 하였다. 디지털콘텐츠도 현행 특허법, 저작권법상의 요건을 충족한 경우에는 동법에 의한 물권적 지배가 가능하다. 그러나 디지털콘텐츠는 비대면, 비현물의 속성상 등록절차를 요하는 특허법 등이나, 창작성을 요구하는 저작권법에 의하여 충분히 규율하기 어려운 점이 상존하므로 디지털콘텐츠 제작자에게 손해배상청구권이나 침해행위 중지청구권 등을 부여함으로서 디지털콘텐츠제작자에 대한 법적 보호를 모색하려는 시도는 매우 타당하다고 판단된다. | - |
