| dc.description.abstract | 본 연구는 한국과 일본 간 첨예하게 대립하고 있는 강제징용 배상판결에 관한 대립 경위를 중장기적으로 파악함과 동시에 판결 근거 및 사법적 견해차이, 그리고 정부입장에 관하여 국가 간 비교분석을 실시하였다. 이를 위하여 1965년 한일기본조약의 내용과 한계성에 관한 고찰부터 1997년부터 2020년까지 일본제철 및 미쓰비시를 상대로 한 강제징용 손해배상 청구 소송의 배경과 흐름, 쟁점, 사법적 판결 근거 등을 중장기적으로 검토하였다. 다음으로는 강제징용 손해배상 대법원 판결에 따른 한국과 일본 양국 정부 간의 입장 차이를 비교분석하였다. 연구결과, 강제징용 소송은 식민지시절 피해보상에 관한 협정이 이루어진 1965년 한일기본조약의 불완전성이 주요 배경인 것으로 판단된다. 또한 강제징용 배상판결에 대한 양국 사법부에서는 강제징용 피해자들의 개인청구권은 소멸여부, 법인격 및 소멸시효 등에 대한 판결도 상이하였다. 마지막으로 사법부의 배상판결에 대해 한국정부는 사법부의 판단이 한일청구권 협정을 위반하지 않는다는 입장을 견지하는 한편, 일본정부는 한국대법원의 판결이 한일청구권 협정에 위배되며 국제법에도 위배되는 사항임을 주장하고 있다. | - |
