영화산업의 불공정거래 규제방안: 수직계열화에 대한 구조규제의 가능성을 중심으로

| dc.description.abstract | 영화산업은 제작, 배급, 상영 등의 생산과정으로 구분된다. 이러한 영화의 가치사슬 단계를 수직계열화한 영화 대기업의 출현은 최근 국내 영화시장의 가장 큰 특징이다. 특히 국내의 상영관 시장과 배급시장은 상위 3~4개 기업이 시장의 대부분을 차지하는 과점적 구조를 가지고 있다. 이러한 과점적 구조와 수직계열화의 결합은 공정거래환경의 조성을 저해한다. 불공정거래행위에 대한 규제에는 3가지 방법이 있다. 첫째, 공정거래와 관련된 가장 일반적인 규제수단인 공정거래법을 통한 규제이다. 둘째, 중소기업법상 중소기업을 보호하는 제도를 활용하는 것이다. 마지막으로 산업법인 영화 및 비디오물 진흥에 관한 법률을 통해서도 영화산업 내의 공정거래의무 및 이에 따른 관련 행정기관의 의무와 권한을 도출할 수 있다. 현행 공정거래법이 주로 행위규제 내지 폐해규제에 국한되어 있다는 점을 감안하면, 중소기업법 상 사업영역제한, 영화법 상 영업정지․허가취소 등의 행정조치를 성과규제 내지 구조규제와 연결하여 행사하는 산업정책적 규제 메커니즘에 대한 전망과 이해가 절실하다. | - |
