- Abstract
- 중국 고대의 赦免制度가 생겨난 이후 兩大 변화가 있었다. 즉 사면제도가 죄를 赦하고 과오를 宥하는 것[赦罪宥過] 외에 더욱 광범위한 내용이 생겨났고, 또 사면의 명목이 점점 많아진 것이다. 사면제도의 이러한 두 가지 변화는 중국 고대에 사면이 지나치게 많이 시행되도록[濫施] 하여 법이 범죄[奸]를 징벌하지 못하고 吏治가 부패하는 것 등의 문제를 유발하였다.
