| dc.description.abstract | 우리 사회가 급격하게 고령화 사회로 진입하면서 노인문제가 증가하고 있고, 그 중에서 노인학대가 심각한 사회현상으로 대두되고 있다. 이에 정부는 2004년 1월 29일 「노인복지법」의 개정에서 노인학대의 예방과 대책을 위한 법적 근거를 처음 마련한 이후 수차례 개정·보완하는 한편, 국제적 기준에 맞추어 피해노인의 보호를 위한 노인보호전문기관의 설치 및 관련 정책을 마련·시행하고 있다. 하지만 노인학대에 대한 현행법의 규정이 미흡하여 노인학대의 예방과 피해노인의 보호에있어서 실효성을 기대하기 어렵다는 비판이 제기되었다. 그러므로 본고에서는 「노인복지법」상 노인학대에 관한 규정의 제·개정에 대하여 살펴보고, 동법의 문제점을 검토한 뒤, 노인학대의 방지와 피해노인의 보호 및 학대행위자의 개선을 위한 법으로서 효율적으로 기능할 수 있도록 하기 위한 개선방안을 제시해 보고자 한다. 그 내용은 다음과 같다. 즉, (i) 노인연령기준의 정립, (ii) 노인학대 개념 및 그 유형의 구체화, (iii) 「노인복지법」상 금지행위의 명확화와 보완 등이다. 이외에 노인학대에 관한 독립법률의 제정필요성에 관하여 검토하였으며, 결론으로서 노인학대방지를 위한 대책방향에 대하여 서술하였다. | - |
